I called HSLDA about special needs testing today and asked about the decision concerning the family that had issues with abusing their children and some how brought down all homeschooling in CA. The case in CA is serious and the decision that was made is real according to HSLDA! Homeschooling is now illegal there unless this case is depublished (there is an explanation below) it will no longer be legal to homeschool in CA. As it stands now it is no longer legal unless something is done! That is a problem for all homeschoolers so please even if you are not in CA, sign this petition on the HSLDA site! And get your spouse to sign it separately and all your relatives and friends.
Go to the HSLDA site and sign the petition. It will come down on the drop box on the main page, just wait a moment. http://www.hslda.org/Default.asp?bhcp=1
Here is their explanation on depublication and what needs to be done. HSLDA is not representing the family because they have been and are choosing to stay with a smaller, lesser known and obviously not as powerful legal group. So it is up to other parents to fight the result of their actions! Here is HSLDA's explanation of what can fix it for other families.
"The second appellate option is to seek to have this particular decision “depublished.” Depublication is a decision that can only be made by the California Supreme Court. If the Court determines that the decision should stand, regarding this family, on the facts presented, but that the general pronouncements of law for all of homeschooling should not be determined by this case, then the Court has the option of “depublishing” the Court of Appeal’s decision. This would mean that the case is not binding precedent in California and has no effect on any other family."
